If the deceased victim could have brought a personal injury lawsuit against the party who caused a fatal accident, then the personal representative of the decedent’s estate – usually a spouse or parent – may bring a wrongful death action. This means that wrongful death claims involve issues similar to personal injury actions and arise from the same causes, such as:
