If the deceased victim could have brought a personal injury lawsuit against the party who caused a fatal accident, then the personal representative of the decedent’s estate – usually a spouse or parent – may bring a wrongful death action. This means that wrongful death claims involve issues similar to personal injury actions and arise from the same causes, such as:
- Car accidents,
- Truck accidents,
- Motorcycle accidents,
- Bicycle accidents,
- Reckless driving accidents
- Pedestrian accidents,
- Dog bites,
- Nursing home abuse and neglect cases.
The main difference between a wrongful death and a personal injury claim is the type of damages available to the survivors. In a wrongful death claim, family members may seek to recover compensation for:
- The victim’s medical expenses that were incurred prior to the death
- The victim’s pain and suffering if the victim was conscious of it before death

- The victim’s lost financial support, including educational funds
