I want to use this video to show you how we approach motorcycle wrecks differently than any other type of automobile or car wreck. Motorcycle wrecks are unique in that number one, there is a certain problem that the public has with the perception of motorcycle riders. We have to approach the case in such a way that we can easily and naturally overcome the stigma of being some sort of daredevil or risk taker for riding a motorcycle. The fact of the matter is, motorcycles are very safe. Most motorcycle riders are very safe motorcycle operators.
The problem is, the other people around them not properly paying attention. In nine times out of 10, that’s what causes my clients’ motorcycle wrecks is the other drivers in attention, distraction. We have to make sure that we interview all of the witnesses, gather all of the physical evidence, utilize experts as necessary including human factors experts. These are experts who understand the science of how people see, perceive, react to certain stimulus, to certain things going on in their immediate environment so that we can show that this was not at all your fault. That this was totally the fault of the other driver. Then the other part that we have to deal with on a motorcycle wreck is typically the severity of the injury. By their nature, motorcycle riders are much less protected than someone inside of the cage of an automobile or truck.
We typically deal with much worse injuries to extremities. I’ve handled cases where legs have been amputated for motorcycle riders. I’ve handled cases where the motorcycle rider has lost the use of an arm. Head injuries can be very bad when the helmet helps save the life but it can’t completely protect from the concussion going on inside of the skull of the brain being bounced around and being damaged severely. We have to understand the mechanics of what’s going on internally with the motorcycle rider so that we can well show the level and nature and extent of injury.
I’ve worked with a number of neurosurgeons and neuro-psychologists in past motorcycle cases to show how these brain injuries affect the life and the employment opportunities of my clients because oftentimes, with a brain injury, the person looks fine when you look at them. What is injured is something that you can’t see. That can be difficult to effectively prove. That’s one way that the motorcycle accident cases differ from the car accident cases. The other is the timing of these wrecks. Oftentimes, these wrecks are happening in the summer because motorcyclists don’t want to be riding when it’s bitter cold winter, windy, rainy conditions. They’re here in the summer time, the spring and the fall when all of the tourists are here.
That causes some logistical problems because the tourists then go, “Our witnesses are now out of state.” The people who caused the wreck are now gone from the state. We have to utilize certain methods to track them down properly and effectively so that we can utilize their affidavits and their testimony at trial properly in a way that those are admissible into evidence and can be used to prove the value of your claim.
