Nags Head, a beautiful coastal town in North Carolina, is known for its scenic landscapes and charming community.

Tourists and locals alike are drawn to its natural beauty, but as in any other place, accidents can happen. From car crashes to drunk driving wrecks, these unfortunate events can have serious consequences.

Negligence leaves victims grappling not only with physical injuries but also with a complex legal system that can be difficult to navigate without professional guidance.

This blog post aims to shed light on the essential aspects of accident cases in Nags Head NC, providing insight into the legal rights of victims, the critical elements of negligence, and the importance of timely legal action.

With legal guidance and a thorough understanding of the law, victims can take control of their situation and seek the justice they deserve.

Legal Considerations Specific to Nags Head NC

Nags Head’s unique attributes, stemming from its tourism-driven economy and specific sporting activities, create a distinctive legal environment that deserves the attention of legal counsel who is well-versed in local protocols and rules of court.

How much is my accident claim worth?

Even the culture of the Outer Banks can influence various aspects of your legal claim, from gathering evidence to dealing with local authorities and insurance companies and their claims adjusters.

For someone not from the area or just visiting Nags Head when an accident occurs, navigating this legal terrain can be particularly challenging. Indeed, asking your cell phone, “I need an accident lawyer near me” isn’t very helpful if you were hurt in North Carolina but live in another place like Virginia or Ohio or Washington DC.

If you were injured in North Carolina and think it’s smart to retain legal counsel, chances are you’ll need a local North Carolina attorney.

This is where hiring a local attorney makes sense and offers several key advantages:

Local Knowledge: An attorney familiar with Nags Head’s legal landscape understands the relevant North Carolina accident laws, local laws, procedures, and ordinances. Danny Glover believes it important to carefully consider the impact of local traffic regulations, the jury venire, and the nuances of tourism-related accidents that may be relevant to your individual situation.

Knowing the Players: A local attorney has established relationships with law enforcement, medical providers, experts, and even opposing attorneys. These connections can prove invaluable in gathering evidence, negotiating settlements, and helping ensure a smoother legal process.

In more than one instance, I’ve seen outside counsel flounder when it comes to gathering documentation to support a claim. The folks in Nags Head have their own way of doing things. Sometimes picking up the phone and knowing the person on the other end of the line proves quite helpful – Danny Glover, Nags Head Accident Lawyer

Understanding of Unique Factors: Whether it’s weather conditions that might contribute to accidents or types of accidents that are common due to local tourism, such as drunk driving wrecks, a local attorney has an intrinsic understanding of these unique factors and can incorporate them into the presentation of your claim(s) for damages.

Personalized Attention: For someone visiting from out of town, dealing with an accident’s aftermath can feel isolating and overwhelming. Local attorney Danny Glover enjoys providing a personalized and neighborly approach, often going the extra mile to support clients who may feel out of their depth.

Efficient Navigation: The local legal system may have specific processes or requirements that can be confusing for outsiders. North Carolina is a somewhat unique jurisdiction. Visitors from out-of-state regularly are surprised to learn about our incredibly unfair Contributory Negligence Law and don’t always understand how that can be a tremendous burden to overcome. OBX lawyer Danny Glover would like to guide you through these different legal issues with care and. compassion, hoping to save time and avoid potential missteps.

Dealing with an accident in Nags Head may present distinctive challenges, especially for those not familiar with the Outer Banks.

Hiring a local Outer Banks attorney can turn those challenges into strengths. Our knowledge of local procedures and protocols, and understanding of the area’s unique attributes can provide a crucial advantage, helping to ensure that your rights are protected.

Whether you’re a resident or a visitor, having a local legal advocate on your side can make all the difference in your journey to recovery and justice. We want to provide personalized and effective legal representation to both locals and visitors alike.

In Nags Head, as is the case throughout all of North Carolina, identifying and proving negligence is a critical aspect of personal injury claims.

To successfully establish negligence, four essential elements must be demonstrated: duty, breach of that duty, causation, and damages.

This means showing that the defendant had a legal duty to exercise reasonable care, failed to fulfill that duty, and as a direct result, caused injury or loss to the plaintiff.

What is Gross Negligence?
Gross negligence is a more severe form of negligence that goes beyond mere carelessness or failure to exercise reasonable care.

It is characterized by a reckless disregard for the safety and well-being of others, demonstrating a complete indifference to the potential consequences of one’s actions.

Unlike simple negligence, where a person may have unintentionally failed to act with reasonable care, gross negligence involves a willful or wanton disregard for the rights or safety of others.

Criminal Negligence and Gross Negligence often requires a higher degree of proof and may lead to more substantial penalties or punitive damages.

Drunk Driving Accidents

In the context of gross negligence, drunk driving stands as a clear and grave example.

While simple negligence involves a lapse in reasonable care, drunk driving represents a conscious decision to engage in behavior that is known to be highly dangerous.

Drunk driving is a choice. The changed lives, injuries, and fatalities that are the result of drunk driving are completely avoidable.

Drunk driving is a conscious decision that involves willful disregard for the safety of others on the road.

In North Carolina, this goes beyond mere negligence and can be classified as gross negligence because of the substantial risk involved.

Victims of accidents caused by drunk driving may have the legal right to pursue compensatory damages for their losses. Punitive damages are meant to punish the offender and deter similar conduct in the future.

Consulting an experienced attorney like Danny Glover, who understands the unique complexities of gross negligence related to drunk driving in Nags Head, can be extremely helpful for victims seeking to hold the responsible party fully accountable for their reckless actions.

What is Contributory Negligence and Why is “Contrib” so important?
North Carolina follows the doctrine of contributory negligence, meaning if a victim is even slightly at fault, they may be barred from recovery.

This doctrine can be a significant hurdle, and understanding its nuances is extremely important when it comes to defenses an insurance company may attempt to assert.

Our team at the Danny Glover Law Firm helps clients navigate this complex area, helping make sure you do not inadvertently jeopardize your claim for damages.

What does “Statute of Limitations” mean?
The term Statute of Limitations refers to the laws that set the maximum time frame within which legal proceedings must be initiated.

If an individual fails to file a lawsuit within this specified period, they typically lose their legal right to pursue any type of compensation for their claim.

In North Carolina, the statute of limitations for many personal injury or accident claims is typically three years from the date of the injury.

How long do I have to file a claim?

This time limit underscores the importance of seeking legal counsel promptly after an accident or injury occurs. Missing this deadline can result in losing the right to pursue any type of compensation, regardless of the merits of the claim.
In North Carolina, the statute of limitations for wrongful death claims is distinct from other personal injury claims. For a wrongful death case, legal action must be initiated within two years of the date of the deceased person’s death.
This is a strict deadline, and failing to file a lawsuit within this two-year window could result in the loss of the right to pursue any compensation for the claim. This time frame underscores the urgency of consulting with an experienced wrongful death attorney as soon as possible after the death occurs.

Rushing settlement almost always benefits the big insurance company. Recovery from injuries can take time. While the Statute of Limitations is an important consideration you should know about, we can help guide you through the process – Danny Glover, Outer Banks Attorney

The laws surrounding wrongful death claims can be complex, and understanding the specific time constraints and other legal requirements is vital for the success of the claim. An experienced North Carolina attorney like Danny Glover can help provide essential guidance and support during this emotionally challenging time, helping families navigate the legal system and pursue the justice and compensation they deserve.

Answers to Common Questions about 18-Wheeler Accidents

If you are injured in a trucking accident, you may not know where to turn.

The laws surrounding these accidents can be complex, and insurance companies will often do everything they can to avoid paying out on a claim even if the CDL driver is 100% at fault.

Insurance companies and their adjusters don’t make money by paying what is right.

Profit lies in denying claims made by the passenger vehicle, not taking responsibility when they should, and limiting how much, if any, is paid in settlements when accidents occur.

That is where a lawyer comes in.

Experienced personal injury lawyers understand the nuances of trucking accident law, and can help you get the compensation you deserve for your injuries – Danny Glover, OBX Truck Accident Lawyer

In this blog post, we will discuss some of the most common injuries sustained in trucking accidents, as well as how a lawyer can help you seek justice if you’ve been badly injured by a commercial vehicle.

Why do Insurance Companies Deny Claims?

There are many reasons why an insurance company would deny a tractor-trailer accident claim.

The primary reason is pretty simple: MONEY.

An insurance company makes more money denying legitimate claims and paying less than they should to people who settle without knowing their legal rights.

To be clear, truck accident law is complicated. Wrecks involving commercial trucks and passenger cars often result in substantial injuries and losses.

When is the best time to hire a lawyer?

And truck accidents tend to involve complex legal issues regarding legal liability and whether the truck driver or the semi-truck company is liable.

If you have a truck accident case, it is important to speak with an experienced attorney who can help you navigate the complex truck accident law and work for the compensation you deserve.

How do truck accident laws differ from a car crash?

Truck accidents are governed by both federal and state regulations.

The Federal Motor Carrier Safety Administration (FMCSA) is the main regulatory agency that sets the rules of the road for commercial vehicles.

In addition, each state has its own laws regarding commercial trucks.

When a truck accident occurs, it is important to hire an experienced attorney who knows how to navigate these complex laws.

Most car accidents are governed by the law of negligence.

This means that if someone is injured in a car accident, they can file a personal injury lawsuit against the person who caused the accident.

However, truck accidents are somewhat different than those involving only a passenger car. Truck drivers must use the utmost care to avoid injuring others.

If a truck driver does not use the appropriate level of care and someone is injured, the truck driver can be held liable for the victim’s injuries.

FMCSA Regulations

Truck drivers are also required to follow certain rules and regulations set by the FMCSA.

These rules include things like how many hours they can drive in a day, what types of drugs they are allowed to take, and how often they must take breaks.

Do I need a Lawyer?

If a truck driver violates one of these rules and someone is injured, the trucking company that employs the driver can also be held liable.

Trucking accidents can be complex, but an experienced attorney can help you navigate the laws and get the compensation you deserve.

Why are trucking accidents a serious issue?

In the United States, there are over 500,000 trucking accidents every year.

That’s almost one and a half trucking accidents every minute!

And these numbers have been increasing steadily over the past few years.

Most people think of trucking accidents as simply bigger versions of regular car crashes.

But the truth is, they’re often much more complicated than that.

For one thing, because trucks are so much larger than passenger vehicles, the injuries sustained in trucking accidents are often much more severe.

Common Injuries when accidents happen

Common injuries in trucking accidents with a passenger car include:

Broken bones

Lacerations

Internal bleeding

Head injuries

Spinal cord injuries

Traumatic Brain Injury – TBI

Fatal Accidents / Wrongful Death

Mental and Physical Distress

Liability in Truck Accident Cases

In any personal injury case, the first question is always who is at fault.

When it comes to truck accidents, there are a few different parties who could potentially be held liable – Danny Glover, Outer Banks Personal Injury Lawyer

The most common defendants in these cases are the truck driver, the trucking company, and the manufacturer of the truck or its parts.

There are a number of federal regulations that apply specifically to truck drivers, 18-Wheeler trucks, and other commercial vehicles.

Trucking companies are required to follow these regulations in order to operate legally.

If a company fails to do so and an accident occurs as a result, the company can be held liable.

Some examples of common violations include not properly maintaining the truck, not giving drivers enough rest breaks, and exceeding the weight limit for the truck.

Who are the defendants in a truck accident claim?

The first step in filing any personal injury lawsuit is identifying the correct defendant in a truck accident.

In car accident cases, this is usually the other driver involved in the collision.

But in trucking accidents, there may be multiple defendants, including the commercial truck drivers, the trucking company, and even the manufacturer of the commercial truck or its parts.

Depending on the facts of your case, you may have a claim against one or all of these parties.

An experienced personal injury lawyer will be able to investigate your accident and determine who was at fault.

The U.S. Department of Transportation’s Federal Motor Carrier Safety Administration (FMCSA) reports truck accident statistics indicate the leading cause of large truck accidents and serious injury in the trucking industry is driver error.

In fact, FMCSA data shows that driver error is to blame for nearly 87 percent of all commercial truck accidents.

There are many different types of driver errors that can lead to large truck accidents, but some of the most common include:

Distracted driving

Speeding

Driving under the influence of drugs or alcohol

Reckless driving

Fatigued driving

While driver error is the leading cause of commercial truck accidents, there are other factors that can contribute to these wrecks as well. Some of these other factors include:

Poor Vehicle Maintenance

Inadequate training for truck drivers

Improper Cargo Loading

Defective truck parts

Equipment Failure

Hazardous weather conditions

Lawyers who help clients with 18-Wheeler accidents will thoroughly investigate the causes of truck accidents to determine who is liable and help their clients recover the compensation they deserve.

Federal laws set the standard for what Truckers are supposed to do

Unfortunately, not all Truckers follow these laws, which can result in serious accidents.

If you or a loved one have been involved in a trucking accident, it is important to know what to do and who can help you recover the compensation you deserve.

Trucking accidents often result in serious injuries, such as spinal cord injuries, traumatic brain injuries, and amputations.

These injuries can have a devastating effect on victims and their families. In addition to the physical pain and suffering caused by these injuries, victims may also face significant financial burdens, such as medical bills and lost wages.

What types of accidents are classified as “Trucking Accidents”?

Trucking accidents are any type of accident that involves a large commercial truck, such as an 18-wheeler.

These types of accidents can be very serious and often result in injuries or even death.

Everything seemed clear. The person who caused the wreck took full responsibility and even apologized. My medical bills were reasonable. Why was my insurance claim denied?

It happens. . .a lot. Despite clear liability, insurance adjustors in North Carolina regularly deny valid claims.

There’s a reason for that: The NC insurance laws make it worthwhile to deny claims.

Insurance companies make money at the expense of others. They profit by paying less than they should. It’s extremely profitable to settle for less than what an insurance claim is worth. The highest profit margin involves denying the claim entirely.

Denying valid insurance claims is why accident lawyers have a job. If insurance companies paid like they should, we’d be out of business – Danny Glover, OBX Lawyer

The process of settling up for truck accidents, motorcycle wrecks, and even a simple car wreck in the Outer Banks is likely more complicated than you might realize. In part that’s because of things like contributory negligence laws and legal defenses such as last clear chance.

Denial of Benefits – Denial of Insurance Claims in NC

Make no mistake, the insurance lobby in North Carolina is powerful. For years they have attacked the jury system, making sure North Carolina is one of the very few states in the nation that still acknowledges contributory negligence rather than comparative negligence like South Carolina.

Who is Responsible for an Accident?

Plaintiffs lawyers aren’t allowed to mention the existence of car insurance during a trial. Even if the tort feasor (the person who caused the accident) was negligent, they still may allege you had the “last clear chance” to avoid the accident, once again shifting the burden from themselves.

Despite all the marketing you see on TV, insurance companies aren’t there to help you. They collect premiums and do everything they can to avoid paying claims. Mind you, that’s entirely legal. They are given tremendous protections under the insurance laws in North Carolina.

That doesn’t mean it’s right. Hard working folks in North Carolina want what is right, what is fair. Our clients are regularly shocked when we tell them how things are under the law – Danny Glover, Outer Banks Attorney

That doesn’t mean you don’t have legal rights. There may be legal options available. Even if the insurance adjuster has denied your valid claim for damages and injuries, we may be able to help.

Frankly, that’s one reason we have a system of justice in our country and North Carolina. The Founders of the United States understood how easy it is for powerful interests to take advantage of average people.

And that great equalizer is fundamental to our country as a whole. The last, best protection available against monied interests is the right to a Jury Trial.

When all else fails, we tell big insurance companies, “We’ll see you in court” and we mean it.

What is Contributory Negligence?

It sounds simple enough, maybe even a bit innocuous. Does it make sense that if you contributed 1% to your damages, you get nothing? That’s right, nothing. That’s contributory negligence in North Carolina.

No Such Thing as an Accident

Even if you did everything right, given the power of what happens under the law, it isn’t very hard to see why insurance adjusters might find a way to deny your claim.

It’s one reason why they want to get a recorded statement as soon as possible. It’s easy to twist your words. They’ll ask questions like:

Were you speeding?

Did you see the other vehicle?

Were you 100% paying attention?

Could you have slowed down a little bit?

What other accidents have you been in?

Do you have any pre-existing medical conditions?

Had you been drinking, at all?

Were you distracted, at all?

Were there any kids in the car?

Were you talking on your cell phone?

Were you changing the station on your radio?

Were you eating or had you just been through a drive-through?

All those questions are intended to catch you up, to somehow show you weren’t paying attention. Even if their “insured” caused the wreck, if the insurance comes up with something, almost anything to show you contributed to the accident or could have somehow anticipated the negligence of the at-fault party, you get nothing.

That’s contributory negligence. That’s why insurance companies deny claims. They pay nothing. You get zero.

Who’s at fault means, “Who caused the wreck” under the NC accident laws. Liability for accident injuries in North Carolina is related to negligence and the duty of care.

Sometimes more than one person can cause the wreck, sometimes 100% of the fault rests on one driver.

Determining who is legally liable for accident injuries in North Carolina requires careful review of the documentation of the wreck scene and causes of the NC accident case.

Establishing legal “liability” is one of the more important aspects of any personal injury law case in North Carolina. That’s because under the wreck laws of the state, there is something called contributory negligence.

Looking at who caused the wreck and who is responsible is one of my most important jobs as a car accident lawyer in North Carolina – Danny Glover, OBX Lawyer

Important considerations in NC wrecks cases:

How fast were the vehicles traveling?

Was anyone going above the posted speed limit?

What were the roadway conditions?

What were the weather conditions?

Who had right-of-way?

Were there proper stopping distances?

What should I do after a car accident in North Carolina?

Being involved in a serious collision is a big deal. As a law office that helps people in northeastern North Carolina with car wrecks, motorcycle injuries, and semi-truck collisions, we understand the trauma associated with an MVA or Motor Vehicle Accident.

After a wreck, people can respond differently. One of the more common emotions or reactions after almost any type of accident is disbelief. They “just can’t believe” he ran that light or failed to stop. We hear things like, “I looked right at her. She saw me. I don’t know how she didn’t slow down.”

How To Use Insurance When Injured In A Car Wreck?

Car accidents in North Carolina are generally not caused by people acting intentionally. They involve things like negligence, the failure to maintain proper lane control, and careless or reckless driving.

The vast majority of personal injury cases in NC happen because the at-fault motorist was not paying attention or failed to act responsibility. That almost always means someone was breaking the law when they hit you.

How people respond after an NC car wreck depends a lot on what happened on the scene. If you or your passengers were hurt, that may complicate things too.

The first thing to do is to make sure nothing worse happens. Secure the accident scene. Get people out of harm’s way. Once you are certain everyone is safe, then begin collecting evidence of the wreck – Danny Glover, Outer Banks Attorney

So in North Carolina, the at-fault driver and that driver’s insurance company are responsible to pay all of the damages, harms, and losses suffered by anyone hurt by that at driver’s negligence or carelessness. That may include things like medical bills, the costs of physical therapy, surgeries, prescriptions, pain and suffering, and property damage.

So when we talk about liability, we mean, who was responsible to pay the injured person or the injured people as a result of the wreck? Is it the person who caused the wreck? Is the insurance company liable? Who pays for damages after a motorcycle accident? Is it different for a truck accident or pedestrian injury?

Should I Call an OBX Accident Lawyer?

How do I protect my injury claims after a North Carolina car wreck? What should I do after an accident?

First, make sure someone has called 911 and reported the accident. That is especially true if there are injuries involved after the NC car wreck. Once that has been done, and after making sure everyone is OK, start collecting information if you are able.

Sometimes all that is possible is exchanging information; but, we recommend the following for the best results:

Take out your phone and start taking pictures

Video the scene

Snap a shot of the other person’s documentation

North Carolina Driver’s License

Insurance Card

NC vehicle registration

Ask other people involved in the wreck what happened

Get their information

Take a picture of their driver’s license

Record what they tell you

Accident injury legal claims in North Carolina can get complicated. That’s because there often is a multi-step process for seeking money damages, including the possibility of Arbitration in North Carolina or mediated settlement process.

What is the difference between Arbitration and a Jury Trial?

Is arbitration a good thing or a bad thing?

Is it required or “binding”

Arbitration in North Carolina: What is it?

Arbitration and “Binding Arbitration” is something we are seeing with more frequency in North Carolina, especially involving cases where people have agreed to the methodology of settling a claim.

That is sometimes done by contract. Arbitration is not required to be binding; but, companies often put provisions in contracts and agreements regarding arbitration. And often, they set things up to their advantage.

Binding Arbitration basically means there really isn’t an appeal. If you’ve agreed to binding arbitration, it’s very difficult, if not impossible to appeal that ruling.

North Carolina has legal provisions in the North Carolina General Statutes for Arbitration. Those can be found in: Article 45C of the Statutes. It’s referred to as the Revised Uniform Arbitration Act.

NC Arbitration Laws

Is Arbitration Required in North Carolina Courts?

Yes and No.

IF the Court Orders Arbitration in North Carolina, you are required to participate; but, Arbitration is not always available in every county or Judicial District in North Carolina. We provide legal representation to people throughout northeastern NC and the Outer Banks.

Here are the general rules about NC Arbitration:

Counties that HAVE Court Ordered Arbitration

Required in Every Civil Case

Involving a Claim for $15,000 or less

Required after Small Claims Court

If appealed

Involving Claims for Money

IF the Court decides the case is Subject to Arbitration

When the Magistrate’s Order / Ruling is appealed

What is the purpose of Court Ordered Arbitration in North Carolina?

More than anything, it helps people get a good idea of the value of the case or claims.

In North Carolina Arbitrations are handled by Lawyers specifically trained in the process of dispute settlement and mediation. While mediation is a legal term, the point is for people to work through or “mediate” their disputes.

Arbitration is different from Mediation. Arbitration is more like litigation, where there is a formal presentation of materials and decision. It is purposely intended to be more informal; but, that does not mean the effects of Arbitration are any different than the traditional process of civil litigation, discovery, and lawsuits.

Wrongful Death Claims NC

An Arbitrator is a neutral Court official in North Carolina.

The Arbitration Hearing is in some ways like a trial. Each side to a dispute has the opportunity to tell their side of the story. Like a Jury Trial in North Carolina, each side is allowed to present evidence at an Arbitration.

They can also call witnesses and introduce documents for consideration.

Like a Judge or a Jury Trial in North Carolina, a decision is made. Normally that would be called a Verdict.

Whether it is a called a Jury Verdict or Ruling doesn’t much matter. There is a formal decision made.

Applying North Carolina Laws, a decision is made that determines “who won” and “who lost” in the dispute.

Modified Transcript of “What is Arbitration” for the Hearing Impaired

Arbitration is more formal than mediation but less formal than trial, and there is one neutral person hired and paid for by all the different sides to the lawsuit.

Instead of a judge or a jury deciding your case, the arbitrator actually listens to the evidence typically in a more informal abbreviated way and then rules in the case.

Typically, the decision of the arbitrator is binding, meaning neither side can appeal. Sometimes arbitrators are retired judges, sometimes they are practicing attorneys, and sometimes they are simply professional arbitrators such as in construction cases.

Basically, arbitration is an alternative to trial, and it is less formal and more abbreviated.

The mediator makes sure that they’re all present and that they all at least attempt to discuss the case so that they can all make sure that they know all of the important facts to see if there’s any chance to settle the case before incurring further litigations costs, time, the emotional stress of that.

Whether you’ve been in a car accident or suffering the effects of a workplace accident or were the victim of medical malpractice, hiring an accident lawyer can be essential to ensure your injuries don’t put a permanent dent in your wallet and lifestyle.

But what exactly does an accident attorney do? And what steps do you need to take before you call? Read on for a step by step guide on what you should do before you pick up the phone. If you Googled, “Should I Call an OBX Accident Lawyer?” we’re here to help.

Legal Representation: Accident Injury Lawyer

Personal injury lawsuits, also called tort claims, involve some sort of injury or damage to a person and/or property as a result of the wrongful or negligent actions of another person or entity. 20% of the Tort claim lawsuits filed in the U.S. are related to traffic accidents. Personal injury claims can also result from construction accidents, medical malpractice, defective products, or dog bites.

Most tort claims in the U.S. result in a settlement, meaning the claimant is given a sum of money as compensation for the damage and/or injury incurred. An accident attorney’s role, in cases of a settlement, is to get you the highest settlement amount possible and then to make sure that the money is properly paid to you, medical providers and, in some cases, health insurance companies as required by law.

To do their job, accident attorneys need a number of things from you, and it’s often easier if you gather the requisite information before you get in touch.

But first things first:

Ask Yourself: Do I Need an Accident Lawyer?

Generally, it’s a good idea to hire a lawyer if you motor vehicle accident involved:

Serious Injury

Wrongful Death Claims

Catastrophic Loss

Spinal Cord Injury

Traumatic Brain Injury TBI

Construction Zone Accident

A “drunk driver” or “drunken driving” caused the Accident Injury

Trucking Accident / Truck Driver “At Fault” Accident

Semi Truck Accidents

Transport Vehicles

Buses, Vans & Heavy Equipment Vehicles

Seeking an attorney’s advice and legal representation for settlement negotiations can be beneficial. Attorney-client privilege ensures everything you tell your OBX lawyer remains confidential.

Take Down Witness Information

It’s important to take down the name and a contact phone number of anyone nearby who may have witnessed the accident. If the police responded to the accident, then they may do this to include in their report but in some cases, key witnesses have already left the scene before the police arrive.

Gathering witness information after an Outer Banks Accident is often imperative given the number of visitors on the roadways, especially during peak holiday seasons – Danny Glover, OBX Lawyer

Ensuring you have access to all the available witness accounts will help you present an accurate representation of the events as you build your case.

Go to a Doctor after an OBX Accident

If you intend to report you were injured in the accident then going promptly to a doctor is one of the best things you can do for your case. Most insurance companies expect that if you incurred pain or injury in an accident, you will go to the doctor or hospital. Not doing so will give them an opening to argue you weren’t harmed.

If you don’t have health insurance then your best bet is to go to the emergency room of a hospital. They can assess your injuries, take x-rays if needed, and prescribe appropriate medication.

Take Pictures: Scene and Damages

It’s important to take pictures of any injury and/or damages that occurred in the accident. Pictures give the most accurate representation of what occurred.

If your accident involved a motor vehicle, take pictures of any damage to the vehicles. Also, be sure to detail your own injuries. A seatbelt mark often gives a much clearer picture of the severity of an accident than just a photo of a dented bumper.

If any property, including handheld devices like tablets and phones, was damaged then be sure to photograph that as well.

Get a Repair Estimate

For car-related issues, in particular, insurance companies often have their own recommended body shops. But you can and should take your car to a repair shop of your own choosing.

Getting an estimate for repairs to damage incurred during the accident will help you gauge what sort of settlement you should be aiming for.

Request Police Report

If police responded to the accident then they will have submitted a report. Obtaining a copy of that report is essential in pursuing your claim.

Calling the police station and asking for help in ordering the report is your best bet, as different departments often have different procedures. Information can often be found on police or highway patrol websites as well.

There is often a small fee for copying and processing the report to give to you.

If you’re not sure which police station or department to call, call the department of the city where the accident occurred. They can often point you in the right direction.

Record Your Recollections as “Attorney-Client” Materials

Write down every detail of the accident in one place and keep that list handy when you call the accident lawyer. No detail is too small when it comes to accident claims, so note down everything you can think of.

At the very least you should have:

The date of the accident

Who was involved

Where it happened

Whether police responded and if so, a copy of the police report

The dates you sought treatment for injuries incurred in the accident

The names and contact details of the medical professionals who treated you

The names and contact details for all witnesses, passengers and any investigating officers

The more information you can provide to your attorney, the better legal advice and service you will receive.

In Conclusion

Preparation is essential for tackling an accident claim, and that preparation starts before you pick up the phone to a lawyer.
